Filing a Consumer Complaint in Delhi: A Step-by-Step Guide

Whether you've been sold a defective product, faced a deficiency in service (like a builder failing to deliver a flat), or been subjected to unfair trade practices, the Consumer Protection Act, 2019 provides a robust mechanism to seek justice.

Step 1: Send a Legal Notice

Before rushing to the consumer forum, it is advisable to send a legal notice to the opposite party outlining your grievance and demanding a resolution within a stipulated timeframe. This often leads to an out-of-court settlement.

Step 2: Determine Jurisdiction

Depending on the value of the goods or services paid as consideration, you must approach the correct forum:

  • District Commission: Up to ₹50 Lakhs
  • State Commission: ₹50 Lakhs to ₹2 Crores
  • National Commission (NCDRC): Above ₹2 Crores

Step 3: Draft and File the Complaint

The complaint must clearly state the facts, the deficiency in service or defect, and the relief sought (refund, replacement, compensation, and litigation costs). It must be supported by an affidavit and relevant documents (invoices, receipts, emails).

Step 4: The Hearing

The forum will issue a notice to the opposite party. Both sides will file their evidence and written arguments. Consumer courts are generally faster than civil courts and aim for a speedy resolution.
